Interesting because this is an issue with Volvo’s non-car related branch so they don’t really have a direct stake in it, thus it’s hard to say how it will go down. I feel sorry for Dave—he’s done so much for the brand and the enthusiast communities and this is how he gets rewarded. A shame.

I don’t know the specifics and intricacies but I’ve heard that failure to protect a trademark can lead to some loss of rights; so even if as a company you like what someone does; you need to protect your brand name.

If Volvo was cool they’d grant Dave a license allowing them to use their brand. Land Rover gave the club I belong to permission to use their logos/Name on our club stuff.  

Seems Volvo isn’t cool though.

Worth it though, just for the sake of keeping some of your biggest fans and supporters on your side. Not like they don’t have dozens of attorneys on the payroll already. Print out some standard boiler plate, get a sig, and keep on truckin’. I bet one of our resident oppo lawyers would even donate the ink and paper.

I think the guy had been in contact with Volvo company dudes earlier. And so far they have been ok with this. I think Volvo should have send the letter immediately and not several years later. Carroll Shelby lost the rights for Cobra cars as he woke up way too late with his claims.

Depends. Volvo Trademark Holdings is owned equally by AB Volvo and Volvo Cars so it depends on which of these is being difficult.

It’s funny—it’s Volvo’s Truck/Bus branch that is doing this since the cars are now under Geely; they seemed not to care under Ford, but apparently Chinese ownership changes everything.

The Volvo brand is actually owned by Volvo Trademark Holding AB, a 50-50 joint venture between Volvo AB and Volvo Car Corp. Essentially, each company has to sign off on any new use or change of use by the other partner.

What they may do is simply get together and agree on which of the two companies will handle which trademark violation cases, perhaps it was just Volvo AB’s turn in the rotation this time?

I don’t know for sure if they really do divide up the workload like that or anything, Volvo Cars might not even be involved at all - purely speculation on my part.

But, that is how the trademark ownership is structured - technically, neither Volvo company owns their brand.
